Queensland Racing stewards stand down club officials

Queensland Racing Limited (QRL) stewards today stood down raceday officials employed by the Mackay Turf Club who were not acting in the best interests of racing following a concern expressed by a stakeholder at the Mackay races on March 19, 2009.

The resultant investigation of the complaint by stewards revealed that the clerk of course, the starter and some barrier attendants employed by the club to carry out raceday duties were consuming alcohol in an on-course machinery storage shed. Stewards conducted breathalyser tests that revealed positive readings. The raceday officials were stood down from officiating at any race meeting until investigations conclude and a comprehensive investigation will be conducted as soon as possible.

“Stewards have an obligation to uphold integrity at race meetings and in particular to ensure the safety of riders and horses,” said QRL chairman Mr Bob Bentley.

“For club officials to perform official functions under the influence of drugs or alcohol while working around horses is absolutely unacceptable at any level of racing as it poses significant risk to horses and riders.

“QRL stewards have been particularly active in the enforcement of drug and alcohol regulations and have had concerns for some time at the loose control of some integrity functions carried out by race clubs.

“This latest incident at Mackay unfortunately comes on the back of an incident of sharpened spurs being used at barrier practice at Eagle Farm racecourse and the attempted cover up by Queensland Turf Club employees in giving false evidence to a steward's inquiry. Details have been forwarded to the director of the Office of Liquor, Gambling and Racing.”

Mr Bentley said today that the board of QRL had been monitoring the aspect of allowing clubs to perform a limited role on raceday but had increasing concerns about race clubs' ability to supervise to a reasonable and trusted standard.

“The board will introduce new regulations to control all raceday integrity functions from the start of the new racing year removing this responsibility from race club committee control. The new measures will apply from August 1, 2009, in conjunction with the prohibition of the use of stock whips behind barriers,” said Mr Bentley.

"This again highlights the effectiveness of the current control body structure and the dangers of reverting to a system of increased club control and influence.”

SEEMS theres some problems with the lemon{orchard} decisions and the drink-o-meter,the discrimination commisioner and the un-lawful sacking of sober staff....oooopps.....google todays daily mercury for the scoop and the unfair dimissals boss stating that qrl and the mackay turf club commitee have a case to answer?
and to think the ning nong bentley boy president of the shit-iffic mackay turf club has applied to be on the qrl board.....this pee-nuts name s one ian joblin and his complcit b-grade commitee that made the decision have been hit with one resignation from their stacked voting block already.;.........the joke that is qrl and mackay racing continues but hey this stakeholder told em so 2 years ago...funny to watch the humble pie that ill soon emerge....qrl integrity?

Workplace Ombudsman Don Brown has been quoted extensively here which is most unusual seeing as he's  in the position of an independent umpire.

Prior to being appointed to this job Don was a state Industrial Commissioner for a few years and before that was Secretary and President of the Miscellaneous Workers' Union.He'll see they get a fair go.

seems the dill president and nominee for qrl board position took the lemon/onion{orchards &bumbling bob's advice ad-hoc} tsk tsk.
they get the cull order from qrl meet as a stacked voting block and sack the next day all the barrier staff not just the ones found to have consumed liquor{no excuses made here for their behavioue}.......then the machine didnt work properly and the big drama with so much money at stake it seems they didnt get/take any legal advice from their solicitors.....ooooopps
proper procedure and conultation that has been bentheads downfall time and time again should have been --qrl cull--mtc commitee meeting-referral to legal advice---follow legal advice so as not to get sued and hauled before un-fair dismissal=====easy
this pee wee wants to be on the qrl board buyer beware stop bye bop

looks like lickety split mackay turf club in a heap of very costly trouble as predicted witha scathing report on them and qrl's actions....will see if its on the daily mercury website for someone to post....industry inspector states the worst case of unfair dismissal in 30 years

integrity? qrl pty ltd have none and based on the mia's in dr bob mason ,wayne woods,andy hedge and now the lemon{orchard} with the butts debacle and now the seemingly costly mtc farce it sinks below zero and to think they are judge ,jury and executioner with stakeholders livelihoods

Bart gave this a run a few days ago opining that matter should be sorted out without going to court.  That seems to be  a sensible attitude and one the parties should take notice of.

Today in the CM Obi has a bit to say,straying a bit I think,bringing up the Daubney Rafter report,which as we all know cost a bucket load of money and went nowhere.

Although Daubney and Rafter did Ok ones now a judge and the other was promoted too I think.

But back to the sackings and I only know what I've read. There's a jurisdictional problem possibly, depending on the numerical strength of the Turf club's employees,whether the Workplace Relations Act unfair dismissal provisions excludes them.

As Don Brown recommended Magistrates Court as the appropriate jurisdiction to the sacked employees he must think there's a jurisdictional issue . So it would be a common law claim but limited as to the extent of damages that could be obtained if successful and unless they are union members and are represented by their union they may be short of the readys to self fund such an action.No win no pay would be too small potatoes I reckon for any solicitors to be interested. 

As Mackay TC is the employer any action is between them and their former staff. QRL is really on the sidelines here and their role was on the race day itself and not in subsequent events.

I don't know what Obi has up his sleeve but it can't be too important or he would have shared it with us.Wouldn't He? biggrin
