ALLAN SCOTT MORPHETTVILLE– TUESDAY, 23 JUNE 2009 Stewards have concluded their inquiry into the circumstances in which licensed jockey Ty Fagg provided a breath sample which recorded an alcohol concentration in excess of the level permitted by Rule ARR.81B. Under the terms of Rule ARR.81A(3), he was stood down from riding at the Quorn meeting on Saturday, 6 June 2009. After considering evidence tendered, together with T. Fagg’s explanation, he was charged with a breach of Rule 81A(1)(a) in that having presented to ride LOQUOZ in Race 1 he had provided a breath sample which recorded alcohol at a concentration greater than .02% on a breath analyser. T. Fagg, was suspended from riding in races and trials for a period of six (6) months commencing at midnight on Tuesday, 23 June 2009, and to expire at midnight on Wednesday, 23 December 2009. In determining this penalty Stewards took into account T. Fagg’s record in relation to breaches of this Rule. T. Fagg will be provided with education and counselling with regard to the responsible consumption of alcohol. He was informed of his right of appeal.
