Beshara alters Happy Trails plea to guilty

Trainer Paul Beshara has changed his plea to guilty of administering by way of injection a medication to Happy Trails on the morning of the Group II Dato Tan Chin Nam Stakes at Moonee Valley on September 14.



The trainer pleaded not guilty at the initial RAD board hearing in October but by pleading guilty Beshara is accepting his six-month disqualification.
Beshara pleaded not guilty at the Racing and Disciplinary (RAD) Board hearing to breaching Rule 178 (E), which deals with race day administration.

 

Paul Horvath, the legal representative for Beshara, delivered the different plea this morning at VCAT in Melbourne where Beshara is appealing the severity of the disqualification imposed by the RAD board on October 21.

John Wallace had the misfortune to be kicked in the chest by a new horse has multiple injuries will keep out of action for a while.

"In other exclusive racing news, affable Gold Coast trainer Johnny Wallace is probably lucky to be alive after being “double-barrelled” by a new horse to the stable yesterday morning. I spoke to Johnny’s jockey son Bradley this morning to get the latest news and Bradley told me, “Yesterday morning Dad went into the box of a new horse to the stable and it double-barrelled him in the chest. He fell onto the concrete and had blood coming out of his mouth. He was taken to hospital and he has a fractured wrist, a cracked rib and a cracked sternum. He’s out of hospital but has been ordered to rest up for a couple of weeks.” Naturally Justracing will keep you up to date in the coming weeks of the injured trainer's progress."

The Hawkes team have entered a filly in Blue Diamond (prelude or preview whatever it is) on Saturday untrialed that I can see,Charge Forward x Lovely Jubly raced by the Throsby's that raced Jubly,unusual for Hawkes not to trial first but that happens a lot in Melb so I would think it had done something somewhere.Boss to ride London Lolly.

I heard GAI Waterhouse was expensive to have as a trainer but I hope that has nothing to do with the Queens COH going from 6mil to 1.6mil in the year Gai has been training Carlton House with no return it appears.
Some big wigs are saying Australians should help her out,sell off most of her slower horses I say Chris Waller will buy them for sure.

Melb Cup winning jockey Bill Smith was attacked by two dogs at the Gold Coast while walking his dog a witness took him to hospital where he is expected to be released tomorrow.

Goldie Locks has a lot to answer for here.... :shutup:

Darley is going to give John O'shea a chance to have an Earthquake for next years 2yo's,they have already named a yearling colt related to Earthquake....Heraldic by Commands x Lindisfarne I can't see him being a Slipper horse tho but you never know.

Whispering....No way...Henry Plumptre said they thought of spreading the teams around different trainers but decided against it....Peter said this morning he can't wait to try and beat Darley horses quickly that is why Paul is starting the stable next month so they are established when Peter is released with a good team of horses going.

 JOHN NIKOLIC OUTED FOR A YEAR

JOHN Nikolic, the trainer licensed by Racing Queensland, has been disqualified for a year by stewards in NSW afteer one of his horses tested positive to a banned substance.

Nikolic, the brother of disqualified Victorian jockey Dan Nikolic, landed a plunge with the horse in question, Wonderful Jester, when it was successful at Murwillumbah in January.

Racing NSW betting steward Terry Griffin told an inquiry that his investigations had revealed ‘strong stable support’ Wonderful Jester when it was backed from $8 to $2.4 and won then returned a positive swab to gapapentin.

John Nikolic, who only resumed training last year after serving a previous disqualification, was again disqualified – this time for 12 months – after pleading guilty to ‘administering the prohibited substance gabapentin on January 3 2014 to Wonderful Jester, which was detected in a sample taken from that gelding subsequent to it winning the Hakka Hire Murwillumbah Class 3 Handicap conducted at Murwillumbah racecourse on Sunday January 5 2014’.

He was also fined a total of $1200 after pleading guilty to another two charges.

The Racing NSW stewards’ report reads:

The Stewards on Wednesday conducted an inquiry into the Analysts’ report of the presence of the prohibited substance gabapentin in the urine sample taken from the racehorse Wonderful Jester subsequent to it winning the Hakka Hire Murwillumbah Class 3 Handicap conducted at Murwillumbah racecourse on the 5th January 2014.

Evidence was taken on Wednesday from Mr John Nikolic, trainer of Wonderful Jester and from Mrs Yvette Nikolic (by telephone), part-owner of Wonderful Jester.

Racing NSW Senior Official Veterinarian, Dr Craig Suann gave advice by telephone to the inquiry, to the effect that gabapentin is an active ingredient in a number of prescription medicines for humans and under the Australian rules of racing can be classified as a prohibited substance by its actions and effects, primarily on the central nervous system.

Evidence was also taken by telephone from Mr John Nikolic Snr (Riders Agent RVL), Mr Kevin McFarland (a warned-off person with Queensland Racing) and from Mr Adam Loxley.

The Stewards received a report from Racing NSW Betting Steward Mr Terry Griffin who detailed information of betting transactions from all Australian betting entities on the race which indicated strong stable inspired betting support for Wonderful Jester whose official betting fluctuations were $6 -> $8 -> $2.4 favourite.

Mr John Nikolic was charged with the following breaches of the Rules of Racing:

Charge 1: Breach of AR80E(1)
 AR80E(1) – Having in his possession at his Gold Coast stables, when visited by Stewards on the 6th February 2014, a blister pack of ten gabapentin capsules which were not labelled or prescribed or obtained in compliance with relevant State and Commonwealth legislation.
 Plea – Guilty
 Penalty – $600

Charge 2: Breach of AR178F(1)
 AR178F(1) – Failing to record treatments to Wonderful Jester and other horses in Mr Nikolics stable between the 25th September 2013 and 20th January 2014.
 Plea – Guilty
 Penalty – $600

Charge 3: Breach of AR175(h)(ii)
 AR175(h)(ii) – Administering the prohibited substance gabapentin on the 3rd January 2014 to Wonderful Jester, which was detected in a sample taken from that gelding subsequent to it winning the Hakka Hire Murwillumbah Class 3 Handicap conducted at Murwillumbah racecourse on Sunday 5th January 2014.
 Plea – Guilty
 Penalty – 12 Months Disqualification

Charge 4: Breach of AR175(h)(i)
 AR175(h)(i) – Administering the prohibited substance gabapentin to Wonderful Jester for the purpose of affecting the performance of the gelding in the Hakka Hire Murwillumbah Class 3 Handicap at Murwillumbah on Sunday 5th January 2014.
 Plea – Not Guilty
 Finding – Not Guilty

Under the powers of AR196(6)(a), the Stewards deferred the commencement of the period of disqualification by 7 days until the 16th April 2014, however, under part (b) of that rule, Mr Nikolic may not start a horse in that period.

Consequently, the period of disqualification will commence on the 16th April 2014 and expire on the 16th April 2015.

Under the powers of AR177, Stewards disqualified Wonderful Jester from its first placing in the Hakka Hire Murwillumbah Class 3 Handicap of the 5th January 2014 and amended the placings to record as follows:

1. How Huge
 2. Daneares
 3. More Dust
 4. After the Bounce
 5. Soul Brother

Mr Nikolic was advised of his rights of appeal.

Yes, backed it from $8 to $2.40 so collected a motza; fined $1200.
Bet he is still giggling over that. :mad:

Some may think the 12 months disqualification is a heavy impost. :no:
I guess it would be if you didn't have a wife or a cousin or other associate that could step into the breach and take over as "official" trainer for 12 months. :whistle:

Not that he could possibly get away with anything like that. :p

in NSW prize money is paid on the 15th (or close to it ) of the month , when racing between the 1st and 15th

and the 30th (or close to it ) of the month , when racing between the 15th and the end of the month .

he will repay the money , for a positive swab

All,

Time for a class action by ALL losing punters on the race ( no matter where they bet or what bet type ) against the trainer?

Such a thing WOULD stamp out the shenanigans far more effectively than a tiny fine compard to the winnings.

I wonder if they swabbed the 3rd horse in Grafton Race 8 on Teusday.

Same trainer , day before he is put out, $9 in prepost into 6/4 and was under the stick a long way out and kept coming.
Nearly got the holiday money.
