Stewards Report - Tony Gollan

Date:   Mon, 29 Oct 2012 04:17:27 PM
Industry:   Thoroughbreds
Type:   Stewards Reports
STEWARDS REPORT

DEAGON – 29 OCTOBER 2012

Stewards – D Aurisch, A Reardon, P Gillard

Racing Queensland Limited Stewards today conducted an Inquiry into a report from the analyst that the post-race urine sample taken from SILVER COMMAND, which competed in race 8 the C,G&E Class 3 Handicap 1200m at Doomben on 5 September 2012, was found to contain the presence of TESTOSTERONE above the allowable threshold as defined under AR 178C (1)(g)(i).

Evidence was taken from Mr. Tony Gollan the Trainer of SILVER COMMAND.

Mr. Gollan subsequently pleaded guilty to a charge under AR 178 for presenting SILVER COMMAND to Doomben on 5 September 2012, for the purpose of engaging in a race, when a post-race urine sample taken from that gelding upon analysis was found to contain a prohibited substance namely TESTOSTERONE above the threshold permitted under the Australian Rules of Racing.

In issuing the charge the Stewards could not be satisfied on the available evidence that the detected levels of TESTOSTERONE in the sample was of endogenous origin as a result of endogenous activity.

After considering all relevant matters, including Mr. Gollan’s good record, he was fined the sum of $4,000.

Under the provisions of AR 177 Stewards disqualified SILVER COMMAND from its win in the C,G&E Class 3 Handicap 1200m and the placing’s were amended as follows:

1st        BRIBIE
2nd       RUN ROYAL RUN
3rd        KEEP IT MOIST
4th        DESERT PLAYBOY
5th        TRAGEDY

Do we even run tests to detect endogenous testosterone, or are we still only testing to see if levels are below the threshold  :what:

The only way to catch out steroid cheats is to test for endogenous testosterone, else trainers using the clear steroids will continue to cheat the system.

As I understand it, "endogenous testosterone" simply means naturally produced testosterone.
I believe it is indistinguishable from artificially introduced testosterone.
That is why we have a threshhold level.
If the level is below the threshhold it is deemed that it could have been naturally produced.
If its above the threshhold authorities know that it must have been administered to the animal and is therefore illegal.

I was pretty sure that all testosterone not produced by the body was detectable, but needed better testing methods.

Porky will correct me if I am wrong  :)

So the leading trainer in Qld for the current metropolitan season  pleads guilty to cheating and gets a fine of $4 000.

Can I assume there is a 2 strike policy in  horse racing?

Next we will have Oliver getting off because he only ever had a bet on one horse in his entire life.

What a joke.

Imagine what would happen to Usain Bolt if he pleaded guilty to steroid use.

Imagine what would happen to Usain Bolt if he pleaded guilty to steroid use.

Pretty sure Bolt would have some endogenous testosterone floating around though

Even I have got some . . though it is slowly  :shy: fading away

From my limited understanding testosterone is found in some products that can be legitimately administered to horses . . BUT if they already have a high natural testost. level these products can push up the level to unacceptable

So trainers with a good rep. may get some 'benefit of doubt'

Please correct me if I am wrong...........................................

Guess I needn't have included that last line, as it would have happened anyway

Yes but Silver Command is a 5 year old gelding.

I understand there is a very generous margin built into the threshhold, so naturally occuring can never get close to it, and a little bit as a minor by-product in a legitimate treatment shouldn't be a risk either.
Remember that a horse can't be given any treatment within 48 hours before a race without stewards permission.
Any trainer worth his/her salt will know which treatments contain significant amounts of controlled substances like testosterone and how long these persist in the system. The withholding period is pretty clear.
They need to take this into account in planning the treatment regime and race program.
Its not always dead easy but it is never as hard as some trainers try to make out when they get caught out doing the wrong thing.

The fine would be purely to deter trainers from running in a race after treatments.
A trainer would ensure the waiting period has gone before running but could be cases where it's on the cusp & they might think horse will be ok. Can be hard for the trainer to judge & he could easily think, well if I scr this time the next suitable race is 3 weeks away, then it'll be 5 weeks between runs, etc, etc.
Take the chance, it'll be ok.
Doesn't really mean they are a cheat, maybe if the horse was treated in the morning & not the arvo of the same day, then would be ok.

Of course if the horse wins & gets disq then looks very poor management skills from the stable.
Doesn't mean the trainer is good or bad, just made an error with time frames.

Of course the owners get the bigger penalty by losing the prizemoney. (& they are not at fault at all)

Maybe the trainer compensates them by free training for a few months.

So E Z you are saying steroids are still in full use and everything is ok so long as you don't  treat inside the positive time frame.

Then I suggest there definately needs to be a lot more testing before race day. Let's hope the Gollan stable gets some unscheduled visits a la Robert Smerdon over the next 12 months.

I would hardly know that, I would doubt it actually.

I'm talking about banned substances in treatments. The trainers know they have to sit their horse out until they 'think' it's all clear. I'm sure they don't get the horse tested before entering again. They just guess that it's out of there system by following a recomended timeframe. They could make errors & race the horse sometimes. Probably what has happened here.

Must be a bit tougher on trainers in WA, than in Qld.

WA trainer gets a year for elevated testosterone level
Racing and Wagering WA stewards have disqualified a trainer for 12 months for presenting a horse to race with an elevated level of testosterone in its system at Northam in September.

Gavin Slater received the penalty after analysts detected "testosterone in excess of (the allowed) 20 micrograms per litre of urine" in a sample taken from Youbetya after the horse won on September 20.

Slater pleaded guilty to a breach of AR178 before stewards heard evidence from the trainer, RWWA vet Dr Judith Medd, laboratory analyst James White and RWWA principal investigator Phil O'Reilly.

Stewards took into account Slater's honesty, the nature of the prohibited substance and the fact it was the trainer's second offence for the same substance, which led to a six-month ban in 2008.

Stewards also stripped Youbetya of his Northam win.

If you want to know why Qld racing is held in such low regard nationally you don't need to look much further than this.
Time will show that the issues currently on show in Victoria are as bad, probably worse in Qld.
At least in Victoria they seem to be willing to do something about it.

Surprising that when searching to find this thread the outdated message pops up ....Warning: this topic has not been posted in for at least 180 days.
Unless you're sure you want to reply, please consider starting a new topic. ........ :o

Tony Gollan has set some records since he made the Forum and is likely to unseat premiership winning trainer Rob Heathcote from this years honours already leading  48 to RH's 42.5 before Saturday.

Looking through the form guide I noticed Gollan only had one runner Saturday a maiden 2yo in a Listed 1400m race ...Fixation which had two unplaced runs before its name ........I considered having something on it as Gollan really has the wind behind him but the head overruled the heart and I let it go and the way it won there'll be more wins in store looked very strong I thought....whatever it is Gollan is a force to be reckoned with.

It's obvious Tony Gollan has progressed in leaps and bounds since relocating from Toowoomba to Eagle Farm...is it just the change of scenery..or new methods and systems or  different training regimes ....or new owners and a better class of horse that have contributed to his rise to Premiership trainer ....yesterday 9yo Gundy Son, who has always been a handy horse with over $500K trousered by his connections, most of it earned when trained by former premier trainer Rob Heathcote, was successful in the Goldmarket earning another $64K....only his second win at that track ..so no track specialist or distance specialist  in days gone by a 9yo still racing let alone earning in top company was a rarity...then there were steroids not allowed now what is it that keeps these old horses racing for so long..whatever it is Tony Gollan has got it. Giddy Up.

Let me add my congratulations to Tony and his team.

Regardless of the numbers of horses involved (Bruce versus Tony) it is a great effort to achieve the result he has in this racing season. Bruce being the man he was would have been the first to congratulate him on his success.

There is so much work involved in running the teams they do week after week.

Fair to say he lost his way with her towards the end.

Trainer Tony Gollan says test flawed as he appeals $8000 fine and conviction for positive swab

NATHAN EXELBY, The Courier-Mail

September 18, 2016 5:00pm

THE lawyer acting for Tony Gollan has questioned the process of Queensland Racing Integrity Commission stewards as he attempts to have a decision against the premier trainer overturned.

Gollan was fined $8000 last week and his horse Amexed stripped of a $65,000 race win at Ipswich after a positive test to the substance prednisolone.

Gollan has lodged an appeal to QRIC’s Internal Review system, where he will argue the testing procedure was flawed.

It is understood the test carried out on Amexed’s urine was similar to that of the cobalt case involving trainer Lyn Paton, whereby both the A and B samples were tested at the same laboratory, the Albion-based Racing Science Centre.

Paton’s disqualification was overturned by the Racing Disciplinary Board, which ruled “the evidence provided as proof of the existence of the prohibited substance was fundamentally flawed and unreliable to justify a finding of guilt”.

There was a similar finding in the case of Rochelle Smith, which continued a long line of cobalt sentences overturned by the RDB on the grounds that the testing procedures did not comply with the Australian Rules of Racing.

While Gollan’s case is at the opposite end of the penalty spectrum to cobalt, his lawyer Peter Boyce, who acted for the family of Daniel Morcombe, argues it should be thrown out on the same grounds.

“There has been a clear finding that is contrary to what the stewards have handed down by a higher body than them,” Boyce said.

“We are simply running with what has already been ruled on. For us, it’s clear. It’s not palatable that they can ignore relevant decisions made by a higher authority.”

But Queensland Racing Integrity Commissioner Ross Barnett said QRIC will appeal the RDB ruling in the Paton case to QCAT and therefore defended the decision of stewards to prosecute other similar cases.

“Until we get a result from QCAT on that matter we will proceed as normal with other matters that occurred before July 1,” Barnett said.

Boyce has also questioned whether Kane Ashby, who will preside over the internal review, has a conflict of interest owing to his involvement as a witness in the VCAT hearings of trainers Danny O’Brien and Mark Kavanagh.

“They need to make sure the person working on the review is not contaminated at all by that (VCAT) process,” Boyce said. “If it’s not satisfactory, we’re off to QCAT.”

Barnett dismissed the notion that Ashby has a conflict, pointing out the hearings are being conducted in different jurisdictions

Obviously he has a chance ....it's a narrow point both tests done at the same Lab....why have two tests if the second isn't done at a different Lab than the first.

Tony had the most winners at the two day Rocky carnival and won hisself a $30K ute...coming to the last race today he was on 12 points two ahead of Ben Currie and Lindsay Hatch.... Currie's horse tried hard and Lindsay's was close up but never looked a winning chance the last winner was trained by Tony McMahon who I think is the race caller.

Too soon for Gollan to move on
NATHAN EXELBY

PREMIER trainer Tony Gollan has watered down suggestions he has plans to move interstate, confirming last night he is committed to Queensland racing for the next few years.

In the wake of news that Racing NSW had plans to develop a super training centre in the Southern Highlands, Gollan said it would be foolish to ignore such developments, but suggestions of him being on the move were premature.

“It’s an exciting concept and something that might appeal to me in a few years’ time if I felt it could be achievable,” Gollan said.

“But there’s a lot of ‘ifs’. There’s not even a plot of land at the moment.

“I am firmly entrenched in Brisbane and I am looking forward to the season ahead.

“My ambition right now is to take horses to Sydney and Melbourne carnivals, hopefully win a few more Group 1s, and be competitive from my Eagle Farm base.”

Gollan said his best chances of success at Doomben tomorrow were Hectopascal and Macewen, who he tipped to go through the grades this preparation.
