Who governs at Racing Victoria?

It is a significant date on the calendar – next Tuesday. It’s not a race meeting but a date specially convened by Racing Victoria to consolidate and pursue changes to its own governance structure.

Yet little publicity has been given to it. The ramifications are enormous and G1X.com.au can reveal the chasm between the governing body (RV) and the shareholders and stakeholders is wide.

Watching over these developments is Racing Minister Martin Pakula, who has long called for RV to lead the way on changes – to what he describes as an out-dated model that “went out with button-up boots” – and is his view, move towards one that ensures independence and integrity.

That is something RV has confirmed it is committed to doing and has been doing so in a consultative process over the past six months.

“The Board has made a recommendation to its 14 Members on a reform of the Board director appointment process,” RV chief executive Bernard Saundry said.

“The recommended change centres upon replacing the current member voting structure with a new appointment panel that will include nominees from industry groups as well as a nominee of the Minister for Racing. The recommended change is to ensure that the process is commensurate with modern governance standards and delivers diverse and highly-skilled future Boards.”

RV presented its case and proposed new structure to the three metropolitan racing clubs, Country Racing Victoria and industry participant representative groups (that’s 14 members) on Tuesday.

But they see the RV proposal as nothing more than a “power grab” to seize industry control for themselves. Hence a standoff is looming, along with a possible no-confidence vote in RV and its chairman David Moodie, and an obvious trigger for Pakula to move in and impose his own model.

Under the RV proposal, the new board make-up would allow the three city clubs (VRC, MRC and MVRC) one vote between them, one for Country Racing Victoria (CRV), one for industry groups, and one Government appointment. The sticking point is that RV has proposed a vote and that includes the nomination of the chairman (total five votes).

“The chances of this getting up are a million to one,” one club representative told G1X.com.au.

“Basically RV is asking the clubs to virtually give up their rights and hand total control to RV who control the election. We want the government to have more say and RV to simply handle nominations and skill check the applicants or nominations then stand back from the process.”

RV said Tuesday’s process was that their nominations sub-committee would address the clubs’ concerns and response to the proposal before deciding whether it would proceed further to the 10 industry groups (comprising representatives from TROA (owners) ATA (trainers), TBV (breeders), AJRA (jumps racing), VBA (bookmakers), VJA (jockeys) and four union groups.

RV said the special general meeting and industry body members meetings are both scheduled to proceed on Tuesday, or may be deferred to a later date, depending on the outcome of the Board's considerations.

 “Whatever the outcome, the Board is committed to ensuring that the industry has a modern governance model to best serve its members, stakeholders, customers and participants,” Saundry said.

Pakula told G1X.com.au last November on The Agenda, governance revue was critical. He said at the time the current antiquated structure of quotas and ballots was “not ideal”.

He said he has discussed with RV chairman David Moodie and Saundry the ideal governance model. He said it is not the “best practice” to have a process where the people who govern can, effectively, “be the people governing themselves”.

“I have had some discussions with Racing Victoria about that, but I don’t think we want to move towards a situation where we have a full statutory authority all appointed by the minister.

“Right now what you have is the integrity controlled by Racing Victoria and you have a Racing Victoria Board which effectively has a lot of racing stakeholders. That is not ideal,” he said.

“I have always said we need to be more independent in terms of the governance model — separate the integrity somewhat without throwing the baby out with the bath water.”

The Board model that Pakula is advocating is one where there is still racing acumen, but greater separation from the stakeholders. “The current board includes several owners, including the chairman,” Pakula told G1X.com.au at the time.

The implication here is that Pakula and the government have given the industry ample time to sort out a new model moving forward and as of today there is a Grand Canyon between agreement and implementation.

A notion of, “if you can’t sort it out, I will,” via the Racing Minister is looming for the Victorian racing industry.

It’s why Tuesday’s meeting is absolutely crucial to Victorian racing’s long-term future with the clubs feeling marginalised and believing RV is trying to seize total control to rule from the top.

As an observer from afar, you couldn't help notice a few "little things" along the way.

There was the delay in the signing off of the racing.com contract by the VRC - they wanted more time to view it.

The same body went explicitly against RV recently when unilaterally announcing they wouldn't be having 30 minute gaps between races at their carnivals.

It must be frustrating for the VRC to have performed all this work for over a century, building up their showpiece of Australian racing, the Melbourne Cup carnival, just to see some interloper waltz in and take over.

This looks like the end play.

The Betfair connection on the board of RV, then the cosy agreement with Jamie Packer's Crownbet (owner of Betfair) couldn't have gone unnoticed.

They look like a bunch of accountants, lawyers and marketers to me. Would any of them know which end of a horse to hold?

Changes ahead for Racing Victoria integrity

The integrity departments of Victoria’s three racing codes will be streamlined into one body if the Government adopts the key recommendation of a report released on Thursday morning.

The Victorian government released the findings of Paul Bittar’s review of the integrity structures and has recommended the Victorian Racing Integrity Unit (VRIU) deliver integrity services for the three codes of racing: thoroughbred, harness and greyhounds.

The other key recommendation will be to remove the 'pathway’ of appeal to the Victorian Civil and Administrative Tribunal (VCAT) from decisions by the Racing Appeals and Disciplinary Board (RADB).

The report, which recommends a single cross code RADB be established, said the appeal to VCAT would "be replaced with entitling a disaffected party to appeal on a question of law to the trial division of the Supreme Court".

Discussion with the three codes will now take place following the release of the report's findings and recommendations, with a two-year time frame for implementation of the proposed changes.

"This is about giving Victorian racing an integrity model that provides rigorous and impartial oversight of the three codes," a government statement read.

The Andrews Government has already accepted “in principle” the findings of the Bittar Review. The VRIU would be established as an independent company, with the three codes equal stakeholders.

The report said:”The VRIU should cover all aspects of raceday regulation and stewards, veterinary services, intelligence and investigations, betting analysis, drug control including testing and associated processes, animal and participant welfare plus associated integrity services such as legal and compliance."

But the proposed VRIU would not seek to combine the functions of specialist integrity service functions into a one-code unit; “cross coding is not a requirement of raceday functions.”

Racing Victoria chairman David Moodie released a statement saying it would take time to digest the recommended changes and the implications for thoroughbred racing in Victoria.

“We support the principle of collaboration between the three racing codes and believe that our expertise and processes will be invaluable in helping to inform future discussions with government, HRV (harness) and GRV (greyhounds).

“We also believe in continual development and strengthening of our integrity programs and resources, as maintaining the integrity of Victorian thoroughbred racing is at the core of our existence.”

Bittar, a former Racing Victoria executive and head of the British Horse Racing Authority, was commissioned by Racing Minister Martin Pakula to conduct a review in June last year, following the live baiting scandal in greyhounds, drug use in thoroughbred racing and integrity issues in harness racing.

“There has been a range of issues across all three codes,’’ Mr Pakula said at the time.

“We have seen some issues in harness racing and we have seen the Monteith report, which suggested that integrity in harness racing needs bolstering.

“In thoroughbred racing, we have seen cobalt still to play out. As a matter of principle, I think it is important that there be absolutely no question of any conflict between those charged with the integrity of the industry and those whose job it is to promote it and commercialise it,” Pakula said.

That's a different approach taking VCAT out of the appeal process and substituting the Supreme Court otherwise seems they have taken a leaf out of Qld's book MacSporran QC but they wouldn't admit it . :whistle:

Strike threat as radical RV blueprint includes proposal to close Moonee Valley and removal of trainers from Caulfield and Flemington

The stand-off between Racing Victoria and the three city clubs threatens to destabilise not just the plans but the industry itself.

A $50 million war chest is at the centre of a bitter feud between Racing Victoria and Melbourne’s three powerful race-clubs.

The clubs have raised the prospect of a strike — meaning abandoned city meetings — unless RV agrees to release the purse strings.

The chief executives of the Melbourne Racing Club, Victoria Racing Club and Moonee Valley Racing Club co-signed a letter of demand to RV chief executive Bernard Saundry on May 2.

They have not yet received a response and at least one of the three clubs is prepared to strike if their demands are not met.

Some relate to media rights and industry efficiency but the biggest fight is over RV’s tight grip on its swelling future fund coffers.

The arm-wrestle between the clubs and the sport’s governing body comes amid secret plans to revolutionise Victorian racing, including a controversial proposal to close Moonee Valley.

The Racing Victoria vision — including the sale of Sandown, removal of trainers from Caulfield and Flemington, which would each have a second track and host night racing, and the creation of a training super centre to the city’s north — is largely to be funded by the “war chest”.

The MRC shares the vision to sell Sandown and eventually relocate Caulfield trainers and the VRC plans to add an extra track and remove the trainers as part of its own blueprint, which can proceed without a cash top-up from RV.

Moonee Valley Racing Club insists there will be no track closure, with chairman Don Casboult saying the RV report proposing it was “poorly constructed’’.

“We’ve been around for 133 years and have a proud and rich history and plans to become even greater,’’ Casboult said, referring to Moonee Valley’s plans to rebuild the track.

The stand-off between RV and the three city clubs threatens to destabilise not just the plans but the industry itself.

A special meeting scheduled at RV next Tuesday — where RV was to have proposed changes to its board member appointment process — was expected to bring the stoush to a head.

Club sources said the proposal to alter the appointment process, which would have reduced club votes, was a “power grab’’ from RV and would have sparked a vote of no confidence in the RV board from the city clubs.

The proposed amendment to the process is now unlikely to occur.

A recent meeting between the clubs and RV was described as “heated’’ — “and we got nowhere,’’ said one chief executive.

Racing Minister Martin Pakula said he was “aware’’ of the strained relationship between RV and the three clubs and said “they need to deal with issues like this in a mature way. Otherwise they invite a degree of Ministerial involvement that I’m sure they’d rather avoid.’’

One club CEO said the Racing Victoria millions should be split evenly three ways between the clubs, prizemoney and the future fund. Another said RV’s refusal to provide money from its coffers gave them no incentive to increase wagering “because we get no benefit.’’

Another said the city clubs are “bleeding’’ and run at a loss each year, adding external ventures such as the purchasing of pubs with poker machines were essential in remaining viable.

“All we are asking for is a fixed time frame to sort all of this out,’’ he said.

RV chairman David Moodie, who is the target of much of the anger from the three clubs, said the war chest was essential in protecting the industry from an uncertain funding future.

He said there are “dark cloud of uncertainty over funding that we have to protect ourselves against’’, referring to the declining revenue being raised via RV’s joint venture with the TAB as punters migrate to other betting options.

“It is incumbent on us as the regulator and governing body to plan for the future and that does not include four city tracks,’’ he said.

An RV source said the clubs were acting purely out of short term self-interest. “We’ve turned around a $50 million debt four years ago to a $50 million profit for the industry’s benefit — where’s the credit for that. All we hear is constant criticism,’’ the source said.

Trainers at Caulfield will be given notice five years before any plan to move them on but it is believed that notice will come in the next two or three years.

VRC chief executive Simon Love said the proposal to add an extra grass track — “one good enough to host Group 1 races’’ — could only occur if trainers had been relocated.

Moodie said Pakenham and Cranbourne could absorb trainers moved on from Caulfield and said a new training centre earmarked for just north of Melbourne, plus an upgrade at Ballarat, would house those based at Flemington.

Clubs united over racetracks' futures

Melbourne’s three metropolitan race clubs are fully supportive of the move to reform industry infrastructure but the clubs have offered luke-warm initial responses to mooted radical changes to the future of metropolitan racing and training in Victoria.

The Moonee Valley Racing Club moved swiftly on Thursday to hose-down suggestions the club could merge with either the Victoria Racing Club or Melbourne Racing Club, or even that Moonee Valley be eventually sold off as part of a restructure of the industry.


In the article is this comment from the Racing Minister:

The Minister for Racing Martin Pakula will be an interested onlooker as the clubs come together to decide on the reform of industry governance and the model for its future infrastructure.

He said it was his preferred option that the clubs work out the issues but included a warning that if the clubs could not do the best job for the industry, the Government was prepared to do so.

“I was hoping to see Racing Victoria and the clubs comes to an agreement on a way forward for better governance,” Pakula said.

“I always like to see the racing industry making the decision to govern itself in a mature and sensible way. If not, the Government will step in, but I would prefer not to.”

That looks like some kind of veiled threat to the race clubs i.e. do as RV say or we will make you do it.

When he says the clubs have to work out their "issues", what issues is he talking about?

From afar Victorian racing is flying. There are no race club related issues.

The only "issues" are those created by RV like the broadcast kerfuffle and the loss of wagering revenue that went with that, and the 30 minute gaps between races. These were not of the club's doing.

RV hits back at integrity claims

Racing Victoria moved to reject claims by two industry leaders that RV stewards are not impartial and rather, impose penalties on jockeys and trainers based on their personalities.

In a Herald Sun article published on Monday, Ross Inglis who is chairman of the Australian Jockeys' Association, claimed the RV integrity department impose penalties on jockeys and trainers based on whether they are liked or disliked as well as claiming the integrity department lacks expertise to conduct certain investigations.

RV also claimed that comments made by Andrew Nicholl, who is the chief executive of the Australian Trainers' Association, implied that the integrity department is not impartial and there was "clear anecdotal evidence" that change was required in the integrity process, including the "manner and style of investigation".

"Racing Victoria categorically rejects the assertions and implications which arise from the comments made by the Australian Trainers' Association and Australian Jockeys' Association," the RV statement read.

Racing Victoria made the following comments in response to the statements made:

• The Stewards do not charge individuals or impose greater penalties on individuals because they do not like them or because of their personality. Any suggestion to the contrary is not only incorrect but offensive to the professionalism of the Racing Victoria Integrity Department. The stewards charge an individual because the stewards consider that sufficient evidence exists to establish to the requisite standard that the individual has breached a rule of racing. The stewards impose a penalty on an individual because the Stewards consider that that penalty is appropriate in light of the circumstances of the rule breach and any relevant precedents.

• The Stewards act in good faith to protect the integrity of racing and a level playing field for all participants.  The Stewards do so without fear or favour. Any suggestion to the contrary is without foundation.

• In his recent Review of Integrity Structures of the Victorian Racing Industry, Mr Paul Bittar referred to the Racing Victoria Integrity Services Department as "the high-water mark in Australian racing". The Stewards are equipped with experienced investigators, veterinarians, betting analysts and legal support.

• Racing Victoria's Integrity Department always obtains legal advice (including as required, external legal advice) prior to charging individuals with serious offences under the Rules of Racing. This process is adopted in relation to all potential serious offence charges. The important check of obtaining legal advice prior to charging individuals ensures that there is sufficient evidence to support those charges prior to them being laid.

• It is noted that Mr Nicholl and Mr Inglis are currently assisting and representing respectively a licensed trainer who was charged on 20 May 2016 by the Stewards with serious prohibited substance, misconduct and welfare-related offences. This matter will be heard and determined by the Racing Appeals and Disciplinary Board (RAD Board) on a date to be fixed.

In relation to other matters raised in Matt Stewart's article, Racing Victoria noted:

• In 2016, Racing Victoria has completed a program of trainer consultation sessions across Victoria which provided a forum for trainers to raise issues regarding the governance of racing in Victoria.  In addition, Racing Victoria is undertaking a focused program of trainer education seminars which are designed to better educate trainers as to their obligations under the Rules of Racing, including with specialist veterinary input.

• Racing Victoria's preference is to educate trainers and jockeys in relation to their obligations under the Rules of Racing.  This education program will continue through 2016.  The vast majority of licensed persons comply with the Rules.  From time to time, the Stewards are required to investigate potential breaches of the Rules of Racing by licensed persons and to take action in respect of those breaches.

• The recent case involving an appeal by licensed trainer and Clerk of Course, Mr Bob Challis, was heard and determined by the RAD Board.

The matter involved two breaches by Mr Challis of AR 53A for his failure to report a horse trained by him bleeding on two occasions. Mr Challis was penalised by the Stewards with a six-week suspension and on the basis that the penalty would not impact his employment.

The period of suspension was consistent with precedent and with the serious welfare and safety issues which arise with a breach of this rule. The decision on appeal involved consideration of developments which occurred after the Stewards imposed a penalty of suspension on Mr Challis. There is an implication contained in the article that this matter was influenced by Chairman of Stewards, Mr Terry Bailey, because of evidence provided by Mr Challis in his capacity as Clerk of Course in a matter involving formerly licensed jockey Mr Danny Nikolic. The suggestion that the matters are related is not only 'mischievous' but is false.

Talk about the moody blues for all and saundry!  -- Racing Victoria is on the skids

This thread looks too complex for mere mortals.

Few TAB punters would understand the issues being debated here --  commentators with  too much insider knowledge of the industry tensions is confusing the understanding for those not on the inside.

Presumably they are wary of speaking frankly lest they be charged with contrived offences.

One thing I do know is that Bruce Clark and Andrew Eddy are trusted observers.

Another thing I know -- and have been saying for months -- is that whoever is running metropolitan racing in Victoria has driven it into a box canyon.

Quick dramatic change of management is required if the damage done to Melbourne racing is to be arrested.

There is no accountability for anything at RVL -- bad tracks, unfair races, insider trading rip-offs et al et al

Where is a Rob Hines?  -- the downhill run started when he left and is gathering pace.

Why was a national icon  -- the Cup -- allowed to be so devalued:  these days,  so many Australians could not give a damn  about it  -- it is not and never will be an 'international race' give it back to the people.

I think the opposite Pete. Reckon they are on the cusp of giving the race clubs the boot and just taking over. They appear to have the minister on side.

Now all they need do is make out obscure and exaggerated claims like the clubs have "issues" to make them look incompetent.

RV comes across as an organization that prescribes to the George W. Bush saying of "you are either with us or you are with the terrorists".

Racing Victoria released a typically bland media statement on Friday dealing with discussions between Melbourne Racing Club chief executive Brodie Arnhold and their own chief steward Terry Bailey.

This came off the back of a private charity event hosted for Pinchapoo on Wednesday night in Melbourne where the guest, Peter Moody, spoke about his life in racing.

Some $20,000 was raised via the racing industry for the worthy beneficiary.

The fallout has been spectacular and disappointing. 

Despite RV promising to respond to a series of six questions to G1X.com.au into the Pinchapoo affair, a late afternoon email left us with the banal general release.

The only concession in the statement is that both Arnhold and Bailey are at blame, not that a reading of the rest of the statement would have you still on that page.

RV chief executive, Bernard Saundry, said, “today was a fruitful discussion and the parties have agreed that the comments, whether made at a private function or to the media, were inappropriate”.

RV asked Arnhold to meet Bailey over alleged comments he made in house at the event. The unverified comments suggested that Arnhold “allegedly” said, “we can fix that” in relation to a comment re the RV Integrity Department.

Despite being a private event this was first reported in the Melbourne Age by Patrick Bartley (who was not there) under the headline “Melbourne Racing Club chief executive Brodie Arnhold in trouble over alleged comment about Terry Bailey and Dayle Brown”.     

His report subsequently quoted Saundry and Racing Minister Martin Pakula in typical shallow comments to bolster the shallow but typical anti MRC story.

But Bailey subsequently went to the Herald Sun with his own version of events, many of which were subsequently withdrawn and retracted from the first published but originally intimated Moody was a “drug cheat”, the MRC support “drug cheats” and the MRC was a “renegade club”.

Saundry refused to offer explanations as to the Bailey comments, yet was happy to issue the banal press release more aimed at the MRC than deal with the real issues in this case.

“Today was a fruitful discussion and the parties have agreed that the comments, whether made at a private function or to the media, were inappropriate,” Saundry said.

“The matter has been resolved and all parties will move forward with the clear intention of working diligently together on the administration of the sport and ensuring they instil confidence in the interests of Victorian racing.

“Racing Victoria is of the firm view that the Melbourne Racing Club understands and values the importance of maintaining the highest integrity standards in Victorian racing for the benefit of all stakeholders.”

While Arnhold was called in to explain his actions, there was no mention of action re Bailey, the head of the Integrity Department, despite acknowledgement in the release he admitted his statements were flawed.

They were more that, they were wrong, inflammatory and defamatory.

Yet the RV release made the MRC the focus and asking them to support.

Hence this: MRC chairman, Mike Symons, offered the MRC’s unqualified support of RV’s integrity department.

“The Melbourne Racing Club’s commitment to integrity in racing could not be stronger,” Symons said.

“The club has always been at the forefront of enhancements to integrity measures in the Victorian racing industry and we unconditionally support the work of RV’s integrity team led by Dayle Brown and Terry Bailey.

“Integrity is the foundation of the racing industry and without it we do not have a viable product which our customers will continue to enjoy and wager on with confidence.”

Absolute babble when the issues are more underlying.

The first heading in the Herald Sun said, “racing chief steward furious over comments by Peter Moody, Melbourne Racing Club chief Brodie Arnhold”.

It said this (after editing): “The Melbourne Racing Club beat their chest about integrity being paramount,” Bailey said.

“What does it take to enforce the rules of racing in this town? You get shot at; family threatened, senior industry figures spread vicious rumours about you. And renegade clubs respond like this.”

Beyond all this is the reason the racing community was at The Emerald Hotel for Pinchapoo on Wednesday night, to raise money for the charity that assists the neddy with much needed hygiene products.

The fallout has taken Pinchapoo founder and chief executive Kate Austin aback.

“It’s so disheartening for everyone who was there on a united front for the charity representing horse racing, not of their own individual beliefs, but to do something good via the outcome we achieved,” Austin said.

“It’s just so deflating to be attached to the politics when all those who were there were there for the right reason of charity and spirit.

“We plan to do more of these around and promoting racing, we’d hope this experience doesn’t turn off any potential partners or guests, that would be so disappointing.”

RACING Victoria chief steward Terry Bailey and Melbourne Racing Club chief executive Brodie Arnhold both expressed regret on Friday over volatile comments they had made this week and vowed to work together at a peace meeting.

Arnhold appeared at Racing Victoria to explain comments he made at a function at the Emerald Hotel on Wednesday night.

At the charity function Arnhold suggested problems suspended trainer Peter Moody had with Bailey could be “fixed’’. The suggestion was that Arnhold could assist in the removal of the chief steward.

The next day Bailey labelled the MRC a “renegade’’ club.

In a statement, the steward and the executive said they regretted their comments.

Govt announces new racing board structure

There were many times during the turbulent past 12 months and beyond when Racing Minister Martin Pakula kept his powder dry, but after Racing Victoria’s handling of the exit of former chairman David Moodie he knew it was time to pull the trigger.

And, today he did just that with the state Premier Daniel Andrews announcing his government will amend the Racing Act 1958 to create an independent board for RV.

While there are regulatory, due diligence appointments and the Parliamentary process to be undertaken it is expected the new look RV Board will be in place, possibly for the start of the new 2017-18 racing season.

One of the considerations for Pakula will be the right number of people for the new independent RV Board. Is it a five or seven member Board?

Time will tell, but the new-look board will be indistinguishable from the current one.

Will any current members survive when new look RV Board is unveiled? Possibly, as several late additions to the Board are viewed by government as fiercely independent, but they will be in the minority, if at all.

RV has been deluged by a seemingly never-ending tidal wave of controversies – the cobalt saga, which is about to enter its third year, as well as the hunt for the mole within RV who leaked the highly sensitive cobalt information.

Add into the mix, in no particular order, the Kate Goodrich, Danny Nikolic and Mark Riley sagas.

There’s also been the Mexican-stand off between RV and its metropolitan clubs over club funding, which has caused much angst and saw Pakula step in to mediate earlier in the year.

As well there was RV’s insistence that Moonee Valley and Sandown should be sold with the proceeds forwarded to RV, which caused untold angst at club level.

All the above instability has hindered RV’s ability to net a new CEO, more than seven months after incumbent CEO Bernard Saundry resigned.

What really has sat uncomfortably with Pakula is the perceived conflicted interests at the highest level within Victorian racing and how various issues as a result were administered.

The reconstitution of the Board will ensure there is no further conflict of interest, perceived or real.

But, the proverbial straw that broke the camel’s back came last Thursday when RV issued a media statement noting the Racing Integrity Commissioner Sal Perna had cleared RV chairman David Moodie from being the source of the leak in the cobalt saga.

What angered both Pakula and Perna is that RV omitted pertinent information from its release.

Perna found Moodie to have “inappropriately disclosed information regarding the positive cobalt swabs of Kavanagh and O’Brien, to Peter Moody, which compromised or had the potential to compromise the integrity of the RVL cobalt investigations” and whatever flowed from that.

He also found Moodie had “knowingly provided misleading and/or incomplete information to the RVL Integrity Council and/or the RVL Board regarding his disclosures”.

For many, RV had attempted to cover up its horrible mess. In effect, the Board signed its own death warrant.

Pakula intends to introduce legislation in 2017 to change the way directors are selected to ensure “a Board which is independent”.

And, here’s the telling, most damning aspect for the current structure – Pakula wants a Board that is “diverse and where conflict of interest is minimised and appropriately managed”.

“It’s vital that an industry of such importance has a modern and independent governance structure to match,” Pakula said.

“It is no longer appropriate for the Board of Racing Victoria to be chosen by the people and organisations that it regulates.”

As it moves towards the new-look Board, the Government will consult with the racing industry in the new year as it finalises the selection model.

The selection model will not alter the fundamental nature of Racing Victoria and the Government is not proposing to create a racing commission or a statutory authority.

With the positions of permanent chairman and new CEO to be filled in the near future, this announcement provides prospective candidates with clarity and certainty around the future governance arrangements for RV.

Yes Virginia, there is a Santa Claus........... and today he  santa-sacked the board that ran RVL in a way that dismayed the punters.

 It was just and just what I wanted for Christmas.

Photo finish operator goes AWOL

RACING Victoria is expected to bring in house the responsibility of servicing the photo finish operational duties as a result of a farcical situation today at Werribee.

The Werribee meeting was delayed 68 minutes after the person rostered to conduct the photo finish service at the meeting failed to attend.

When contacted the person told RV that he did not think he was rostered on.

RV was then forced into the embarrassing position of putting the meeting on hold while another operator was located and made his way to the track.

As a result, all races were pushed back inconveniencing trainers, jockeys, owners and punters.

Noel Callow and Chris Symons were forced to forego rides. Callow relinquished a ride at Moonee Valley while Symons got off rides late in the Werribee meeting as he had early commitments at Moonee Valley.

With the reduced time gap between the last few races at Werribee it made it impossible for Callow and Symons to make their way to Moonee Valley

Matthew Hyland, the CEO of the Victorian Jockeys Association, said it would only be proper for RV to compensate its members who suffered financially through no fault of their own.

“It’s ironic when my members seem to suffer financially for the most trivial of incidents yet today a number of riders are significantly disadvantaged by relinquishing rides through no fault of their doing,” Hyland said.

“They seem quite comfortable when our members make an oversight or an error to rip income from us, but when they make a blue no one seems to be accountable or penalised in any way, shape or form.

“You would like to think RV would financially compensate those members.”

Andrew Nicholl, the CEO of the Victorian-branch of the Australian Trainers Association, described the situation as “disappointing”.

Trainer Clinton McDonald Tweeted: "Racing is flying in Victoria. A TAB meeting with no photo finish camera. I1.5 hour delay. I wonder if anyone will get fined?"

Trainer Troy Corstens volunteered to help out. "I've got a camera on my iPhone. Happy to fill in at Werribee if need be."

RV spokesman Shaun Kelly said RV is as "disappointed as our customers and participants with the situation that has prevailed at Werribee today and apologise for any inconvenience caused."

"Today’s delay is unacceptable and we will now be reviewing our arrangements with the third party service provider to ensure that it doesn’t occur again,” Kelly said.

One RV official said the embarrassing outcome would expedite RV taking over the photo finish operation. Currently, it is outsourced.

“We rely on them to provide a service and they have failed to deliver,” the official said.

“This may speed up the process to bring it in internally.”

How embarrassing a major stuff up  :o

That's a one off (granted a significant one off) but has a valid explanation and doesn't need an over-reaction IMO.

The photo finish information in Victoria that gets to the public via TV is normally so quick and the best in the country.

I was thinking that last weekend when for the umpteenth time we had to wait for an unacceptable amount of time for the photo finish in the last at Randwick when Deploy beat Noble Joey. It was clear to the commentators but the information didn't come through for what seemed over a minute and in fact they had to go to the next race without an official result.

In Victoria they post something very close to the official photo almost immediately and the official result follows almost immediately.

Something very wrong in the Sydney meetings in that respect. They seem to have fallen behind the rest of the country.

RVL is now synonymous with the concept of 'an absolute disgrace' (aka CUB)

Knowing full well that races should not be run at the Valley of Tears , RVL went once more unto the breach of trust with the punting public.

A quadrella paying 13 k  --coupled with the DD races having Trifectas paying 4k and 9 k -- aligned with F4 'should pays ' of 20k and 45k is testament to utter nonsense racing.

The DD paid some 150 when the odds suggested a should-pay of 500 was 'fair'.

Who knows what goes wrong at the VOT and why -- we just know it is a disgraceful track -- one not fit for racing.

.............. will a new board at RVL put a stop to this tripe?

MELBOURNE based law firm Allens has been handed the assignment of identifying the source of the embarrassing and damaging cobalt leak in the Mark Kavanagh and Danny O’Brien saga.

Acting Racing Victoria chairman Mike Hirst said Allens, whose offices are in Collins Street, Melbourne, have been appointed to undertake the investigation.

Hirst said Allens reputation as “one of the top three or four” law firms in Australia led RV to engage them not only to identify the source of the leak but also to recommend a process so such a situation would not again occur.

He said he hoped the Allens investigation would be completed by the end of March.

“There is two parts what we will be looking at. One part is working off the back of the information that (Sal) Perna has given us,” Hirst said.

“And, essentially that goes to whether or not we can establish without doubt who the leak was to the point where that can be made public.

“Perna’s report wasn’t in a form that allowed that to happen.”

Hirst said the other aspect was to put in place a process to ensure such a leak would not re-occur in future.

He said if an individual wanted to “deliberately and maliciously” do something then it would be impossible to stop.

“What we are trying to stop is inadvertent release of information because the process is weak,” Hirst said.

Asked what he believed occurred in the Kavanagh and O’Brien leak, Hirst said his initial view is that it to be “inadvertent” but he said he would await the Allens’ report.

Allens, on its web site, lists its values as “excellence, integrity, respect, performance and one firm”

The latest chapter in this off-chute of the cobalt controversy came about following the findings of Victorian Racing Integrity Commissioner Sal Perna.

Perna found that then RV chairman David Moodie was “not the source of the leak” about cobalt positives to Kavanagh and O’Brien before they were officially informed by stewards.

After RV did not disclose everything in its media release, Perna issued his own statement where he outlined all his findings.

Perna said he found allegations substantiated that Moodie had “inappropriately disclosed information regarding the positive cobalt swabs of Kavanagh andy O’Brien, to Peter Moody, which compromised or had the potential to compromise the integrity of the RVL cobalt investigations” and whatever flowed from that.

He also found Moodie had “knowingly provided misleading and/or incomplete information to the RVL Integrity Council and/or the RVL Board regarding his disclosures.”

Perna included in his report to RV the "probable source" of the leak.

Moodie resigned his position as RV chairman. Mike Hirst has continued as the acting RV chairman.

Not long after Victorian Premier Daniel Andrews announced that Racing Minister Martin Pakula would be introducing new legislation that would pave the way for a more independent Board structure.

Seeing that Mr Perna fingered the probable source of the leak it shouldn't take Allens as long as they've been given to determine if Perna is right....more money down the drain

Victorian Premier Daniel Andrews announced that Racing Minister Martin Pakula would be introducing new legislation that would pave the way for a more independent Board structure.

Get on with it -- there is work to be done -- a revolution to be engineered.

Racing Victoria has issued a statement acknowledging the Geelong track that raced on Sunday had a clear bias.

What sense of responsibility does a santa-sacked board at RVL  continue to display?

............ is their no acceptable idea of  calling off a meeting short of a deluge? -- just 'mits on money' rules.
