Darrell Graham is back in harness after serving a 12 months suspension of his training and driving licenses following the cobalt positive from Mafuta Vautin back in 2015.

In July 2019 on appeal QCAT substituted  QRIC's decision to DQ Darrell for 15 months with a 12 months suspension.

Darrell then applied for a stablehand's license which QRIC refused there's nothing in the AHHR to prevent a suspended trainer /driver being licensed in another capacity unlike the ARB where a suspended trainer is not eligible to be licensed as a strapper ...Darrell copped it twice ...on a stay since 2015 after being disqualifed for 15 months over a positive swab he finally gets a decision on his appeal resulting in 12 months suspension which has just expired ..he would have been better off if the learned QCAT member Prof Aughterson had simply dismissed his appeal in which case he would have been be back in business 12 months ago .... the decision to issue a licence is a discretionary matter but in the absence of reasons in the internal review we are none the wiser as to the grounds on which the original decision and the subsequent confirmation at internal review were made...... now he has been relicensed which makes the decision to refuse his application for a stablehand's license more puzzling.......my understanding is that Darrell has an excellent record the Mafuta Vautin positive the only significant blemish on his othwerwise exemplary conduct...good luck to him from here on in.

Submissions were received from Mr. Grahams legal representative who pleaded not guilty to the three (3) charges as issued and including submissions regarding the validity of the swabbing testing procedures.QRIC Stewards after carefully considering these submissions found Mr Graham guilty of all three (3) charges.

$4K fine 1K suspended.
 
No need to remind Darrell of his right of appeal he knows the drill ...............has been down that road and once successfully got costs award obviously he put up a compelling case as QCAT is generally catch and kill yer own on costs.
